We commit to a responsible handling of your personal data. As a result, we comply with the legal requirements of the Swiss Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (VDSG), the Telecommunications Act (TCA) and other provisions of Swiss data protection law. With regard to the processing of personal data of data subjects who are located in the EU, we will also comply with the provisions of the EU General Data Protection Regulation (GDPR).

This privacy policy (“Privacy Policy”) applies to information collected by Victorinox Swiss Army, Inc. (“Company”, “we” or “us”) on our websites that post this Privacy Policy (collectively, the “Site”).  This document will outline our privacy practices, including how we collect and utilize information obtained from visitors of the Site. This Privacy Policy also describes the choices available to you regarding our use of your information and how you can opt-out of having your information collected.  By using or accessing the Site, you consent to the terms of this Privacy Policy.  IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU MAY NOT ACCESS OR OTHERWISE USE THE SITE. 

Information Collection
We may collect Personally Identifiable Information, such as your name, address, phone number, and/or e-mail address (collectively, “PII”), from the Site only when you choose to provide it to us.  For example, you may choose to provide us with PII when you send us an email, register for the Site, subscribe to our newsletter, and/or participate in other activities, services, features or resources that we make available on the Site.  
If you purchase products or services through the Site, information, including your credit card information, may be collected by our third-party payment card processor, CardConnect. We do not collect access, store and/or process any credit card information. Please read the privacy policy on our payment card processor’s website regarding the use, storage and protection of your credit card information before submitting any credit card information through the Site. We do not have any responsibility for the collection and use of any credit card information, which is the sole responsibility of our payment card processor.  
Our Site may collect certain non-Personally Identifiable Information (“Non-PII”), such as your IP type, IP host address, ISP address, cookie IDs and segment IDs associated with cookie IDs, pages viewed and/or search terms entered, browser type, operating system, duration and frequency of visits, anonymous usage statistics, including frequency of messaging and interaction with other users, clickstream data, downloads, anonymized demographic information, such as age and gender, and other log file data.   Please note that we may use third party service providers, such as Google Analytics, to help operate and provide services in connection with the Site and these third party service providers will collect Non-PII from the Site as well.  
Information Usage  
We may use your PII, as provided by you through the Site, to contact and correspond with you and/or to respond to your inquiries and provide you with information or services that you have requested (e.g., a newsletter).  
We do not sell your PII to third parties for their own marketing purposes or to mass marketers. We may disclose your information, including your PII, to our technical consultants, third party auditors and other third parties who make our Site available or enhance its functionality, as well as third parties who are providing services on our behalf.  Please note that we reserve the right to and may disclose PII about you in response to (a) requests from local, state or federal law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the Site rules or policies, or the rights of third parties or to investigate any suspected conduct which we deem improper.
  
In the event another company acquires all or most of our assets, all data compiled or owned by us may be among the items transferred in that transaction. In such event, all the data will continue to be governed by this Privacy Policy.  Finally, please note that if you specifically consent to additional uses of your PII, we may use your PII in manner consistent with that consent.
We use the Non-PII that we collect through the Site for a variety of purposes, including to analyze interactions with and performance of the Site and to customize and improve the consumer experience.  We may also use Non-PII data from third parties (such as data vendors) pursuant to their own privacy policies, and provide access to or share Non-PII with any number of third parties, including but not limited to business partners, and affiliates.  Similarly, we may enhance the Non-PII collected via our Site with Non-PII collected from our business partners.    
Cookies and Similar Technologies

Clickstream 
As you use the Internet, a trail of electronic information is left at each website you visit. This information, which is sometimes referred to as "clickstream data," can be collected and stored by a website’s server. Clickstream data can tell us the type of computer and browsing software you use and the address of the website from which you linked to the Site.  We may collect and use clickstream data to anonymously determine how much time visitors spend on each page of the Site, how visitors navigate throughout the Site and how we may tailor our web pages to better meet the needs of visitors.  This information will be used to improve our Site and our services. We have undertaken and will undertake commercially reasonable efforts to prevent unauthorized Internet access to user data retained in our servers, however, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information provided online.  We retain your PII, if provided by you through the Site, for as long as your inquiry is active (as determined by us) and for a reasonable time thereafter, or if applicable, for as long as you remain on our newsletter lists.   Even if we delete some or all of your PII, we may continue to retain and use aggregate, anonymous data previously collected and/or anonymize and aggregate your PII.  Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.

Our Site may also contain links to social media platforms, and you may be given the choice of connecting to one or more social media platforms from the Site.  If you choose to do so, then depending upon your social media privacy settings, the PII that you post, transmit, or otherwise make available on the social media platform may be viewed and/or used by others and we will have no control over such viewing and use. We do not control and are not responsible for any use of your PII by or through any of the social media platforms. Data Processing by YouTube
Our Site contains various videos of the platform YouTube, which are embedded with the aid of a YouTube plugin. The platform is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. In case you access a website of our internet presence using such a plugin, your browser establishes a direct connection to YouTube servers. Thereby it is communicated to the YouTube servers what websites that user has accessed. If you are logged in to your YouTube account, YouTube can associate this information with your personal user account. If you want to prevent such data transmission, you must log out before using the plugins. Information Relating to Children 
Our Site is not intended for children under 13 years of age.  We do not knowingly collect information from anyone under the age of 13.  If we are made aware that we have received such information, or any information in violation of our policy, we will use reasonable efforts to locate and remove that information from our records.

3 Cancellation

We process and store your personal data only for the period required to achieve the purpose of the collection or as provided by laws or regulations to which we are subject. If the purpose of the storage is omitted or if a prescribed retention period expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions. In addition, we will delete your data if you ask us to do so by sending an email to internet.support@victorinox.com and if we have no legal or other obligation to retain or save this data.


4 Disclosure to third parties

We only pass on your data if you have expressly consented to this, we are legally obliged to do so or to the extent that this is within the scope of using the website and answering questions, processing inquiries or for possible services requested by you. In addition, we may transmit your data to affiliated group companies in accordance with the imprint.

The use of the disclosed data to third parties is strictly limited to the purposes mentioned. These third party companies are required to maintain the privacy of you to the same extent as we do ourselves. If the level of data protection in a country is not considered to be equivalent as for Swiss conditions or with regards to the DSGVO, we ensure by means of a contract that your personal Data can be protected at any time according to Swiss directives or the EU General Data Protection Regulation.

5 Targeting

By means of a cookie technology, based on legitimate interest, data is collected for the purpose of optimizing our advertising and the entire online offer. 8 Pixels, local storage and similar technologies

We also use other technologies, such as counting pixels and local storage. We use these technologies based on our legitimate interest, for example, to examine which features are particularly popular in order to create a more personal user experience and to promote user-relevant advertising.

Counting pixels (also referred to as Clear GIFs, Web Beacons, or Pixel Tags) are small code units installed in or on a web page, mobile app, or advertisement. These pixels can retrieve specific information about your browser and device, such as the operating system, browser type, device type and version, referring web page, website visited, IP address, and other similar information.

We use the following counting pixels:

  • Bing ads

We also use counting pixels in our newsletter. For each newsletter sent, there is information about the e-mail address used, the subject and the number of sent newsletters. In addition, it can be seen which addresses have not yet received the newsletter, which e-mail addresses have received the newsletter and for which addresses the delivery failed. We analyze open rates, click rates and unsubscribe rates. We use this data for statistical purposes and to optimize the content and structure of the newsletter. This allows us to better align the information and offers in our newsletter with the individual interests of the recipients. The counting pixel is deleted when you delete the newsletter. In order to stop the use of the pixel in our newsletter, if this is not already the case by default, configure your mail program so that no HTML is displayed in messages.


9 Web analysis tools

9.1 Principles

Our website uses features of the following web analytics services:

9.2 Google Analytics

We are using, based on our legitimate interest (i.e., interest in analysis, optimization and economic operation of our online offering) Google Analytics, a web analytics service provided by Google Inc. ("Google," 1600 Amphitheater Parkway Mountain View, CA 94043, USA). Google uses cookies. The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law. Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within our online offer and to provide us with further services related to the use of our online offer. In this case, pseudonymous usage profiles of the users can be created from the processed data. These usage profiles are automatically deleted after 26 months.
We only use Google Analytics with activated IP anonymization. That means the IP address of users will be shortened by Google within Member States of the European Union or in other Contracting States to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. The IP address provided by the user's browser will not be merged with any other data provided by Google.

9.3 Google AdWords

Based on legitimate interest, the advertising program "Google AdWords", which belongs to Google Marketing Services Online, is used. Google AdWords places a cookie on your computer ("conversion cookie") if you have reached our website via a Google ad. These cookies expire after 30 days and are not for personal identification. If you visit certain pages on our website and the cookie has not expired, we and Google may recognize that someone clicked on the ad and was redirected to our site. Every advertiser receives a different cookie. Cookies can not be tracked through the websites of advertisers. The information gathered using the conversion cookie is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. We do not receive any information that personally identifies you.

The information collected by the cookie about your use of the website is usually transmitted to and stored by Google on servers in the United States. Based on the collected information, interest-relevant categories are assigned to your browser. These categories are used to serve interest-based advertising.

We use the data about you acquired with the aforementioned cookie (so-called conversion tracking) for the following purposes:

9.4 Google DoubleClick

By using this cookie, your browser will be assigned a pseudonymous identification number and information about the advertisement displayed in your browser and its call will be collected.

9.5 Google Tag Manager

Google Tag Manager is a solution that allows marketers to manage website tags through one interface. We use Google Tag Manager to integrate and manage the Google analytics and marketing services in our website. The Tag Manager tool itself, which implements the tags, is a cookie-less domain and does not collect personally identifiable information. However, the tool triggers other tags, which may collect data. Google Tag Manager itself does not access this data.

10 Social plugins / social media functionalities

10.1 What Social Plugins are

Plugins are small programs or program packages with which software can be adapted and extended according to your own needs. Many programs such as graphics programs, media players or Internet browsers in their basic version support the functions that the normal user needs. Increasingly, such programs are flexible and there are extensive possibilities for expansion through plug-ins or add-ons.

10.2 Which plugins we use

On our website, we have built links to our social media profiles on the following social networks:

When you open a link to one of our social media profiles, a direct connection is made between your browser and the server of the social network. This gives the network the information that you have visited our website with your IP address and called up the link. If you access a link to a network while logged in to your account, the contents of our page may be linked to your profile on the network. This means that the network can assign your visit of our website directly to your user account and we will receive personal data such as name, email, location, friend list and profile picture. Through this data we can provide certain features on our pages. If you want to prevent this, you should log out before clicking on the appropriate links. An assignment takes place in any case, if you log in to the relevant network after pressing the link.

If you are logged in to Facebook, Google or Instagram while visiting our website via your user account, the respective provider can also assign the visit to the page to your user account. If you interact with a plug-in, for example by clicking the "Like" or "g+1" button, the corresponding information is also transmitted directly to a server of the respective provider in the USA and stored there. The information is also published via your user account in the respective social network and displayed there to your contacts.

Even if you are not logged in to the plug-in providers while visiting our website, the data collected by the plug-ins may be associated with your individual user account. A plug-in sets a cookie with an ID each time the web page is called. Since your browser sends this cookie unsolicited with each connection to a server of the respective provider, Facebook, Google and Instagram could thus in principle create a profile regarding which website the user belonging to the ID has called. If necessary, it would then be possible to assign this identifier later - for example, when later logging in to the provider - again to a person.

If you do not wish to be assigned to your profile by the plug-in provider, you must log out of the respective service before you visit our website. 11 Facebook Connect

We offer the feature "Facebook Connect", which is offered by Facebook Inc., as an option for you to create your customer account as well as for logging into our website and applications.

If you want to use this function, you will first be redirected to Facebook. There you will be requested to log in with your username and password. We do not get access to your registration data. If you are already logged in to Facebook, this step will be skipped.

Afterwards Facebook will inform you which data are transmitted to us (public profile, friend list, e-mail address and current place of residence). You confirm with the button «OK». With the transmitted data we will create your customer account, whereby your friend list is not stored by us. For logging in via Facebook login, a Facebook generated unique token (a long string of letters and numbers) is also stored, which is exchanged during the login process for secure authentication with Facebook.

The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and setting options to protect your privacy, please refer to the privacy policy of Facebook.


12 Your rights

With respect to your data, you have the following rights: Get information about stored data, Correction, Deletion, Restriction, Transfer, Objection and Revocation. If you believe that the processing of your data violates data protection law or your data protection claims have otherwise been violated in any way, you can complain to the supervisory authority.

Please note that the law requires certain data to be kept for a certain period of time. Such data must therefore remain stored with us until the expiration of these deadlines. We lock this data in our system and only use it to fulfill legal requirements.


13 Use of the website by minors

The website is aimed at an adult audience. It is prohibited for minors, especially children under the age of 16, to transfer personally identifiable information to us or to sign up for a service. If we notice that such data have been transmitted to us, they will be deleted from our database. The child's parent (or legal guardian) can contact us and apply for cancellation or deregistration. We require a copy of an official document identifying you as a parent or guardian.

We take technical and organizational precautions to protect your personal data against tampering, loss, destruction or access by unauthorized persons, and to protect your rights and compliance with applicable data protection laws.

The measures taken are designed to ensure the confidentiality and integrity of your data and to ensure the long-term availability and resilience of our systems and services when processing your data. They should also ensure the rapid restoration of data availability and access to them in the event of a physical or technical incident.

Our data processing and security measures are constantly being improved in line with technological developments.

We also take our own corporate privacy very seriously. Our employees and the service companies commissioned by us are obliged to maintain confidentiality and to comply with data protection regulations. Moreover, access to the personal data is only granted to them as far as necessary.
